Terms & Conditions
These terms and conditions apply to all services provided by The2Peas Marketing PTY LTD (“we”, “our”, “us”). By engaging our services, you (“the client”) agree to the following terms.
1. Project Changes
Any change/feedback requests will be categorise in the following way:
– Project work above $10,000 (excl GST) – four (4) rounds of revisions. Any additional changes beyond the third round will be charged at $100 per hour, excluding GST.
– Project work between $2,000 & $9,999 (excl GST) – three (3) rounds of revisions. Any additional changes beyond the third round will be charged at $100 per hour, excluding GST.
– Project work between $1,000 & $1,999 (excl GST) – two (2) rounds of revisions. Any additional changes beyond the third round will be charged at $100 per hour, excluding GST.
– Project work less than $999 (excl GST) – one (1) round of revisions. Any additional changes beyond the third round will be charged at $100 per hour, excluding GST.
2. Cancellation Policy
If a shoot is cancelled within 72 hours of the scheduled start time, a cancellation fee of 50% of the total shoot fee will be charged.
3. Deposit and Payment Terms
A deposit is required for all projects before any work begins. Payment structures are as follows:
For projects under $7,000 (excl. GST):
50% deposit upfront, with the remaining 50% due to unlock delivery of the final product.For projects over $7,000 (excl. GST):
50% deposit upfront, 30% payable after shooting, and the final 20% to unlock delivery of the final product.
Deposits are considered non-refundable once work on the project has commenced. However if The2Peas Marketing PTY LTD do refund a deposit, it will be the total minus time spent on the project at the rate of $100 per hour excl GST.
4. Use of Content
We reserve the right to use any video or photography content produced by The2Peas Marketing PTY LTD on our website or social media platforms. If the client wishes to restrict such use, they must notify us in writing.
5. Intellectual Property
Ownership of the final delivered product is transferred to the client upon full payment.
The client is granted a non-exclusive, worldwide license to use the materials produced by The2Peas Marketing PTY LTD for the intended purposes outlined at the start of the project.
6. Project Timelines
We will make every effort to meet the agreed deadlines. However, we will not be liable for any delays caused by factors beyond our control, including client delays in providing feedback, materials, or approvals.
7. Client Responsibilities
The client is responsible for providing all necessary materials, access, and approvals to facilitate the completion of the project. Delays in providing these may affect the delivery timeline.
8. Final Delivery
The final delivery of files will be in the agreed format (digital or otherwise). Any requests for additional formats may incur extra charges.
9. Liability and Indemnity
While we take care to ensure the highest quality of work, The2Peas Marketing PTY LTD is not liable for any consequential loss or damage arising from the use or inability to use the delivered materials.
10. Confidentiality
We respect your confidentiality and will not disclose any sensitive information provided to us during the course of the project unless explicitly agreed upon in writing.
11. Termination of Contract
The2Peas Marketing PTY LTD reserves the right to terminate the contract if the client fails to comply with these terms, including but not limited to failure to make payments on time or breach of agreed timelines.
12. Amendments to Terms
The2Peas Marketing PTY LTD reserves the right to update these terms and conditions at any time. Clients will be notified of any substantial changes that may impact their ongoing projects.
13. Subscriptions
Subscription Options
Customers may subscribe to our services on either a 3-month plan (with a 15% discount) or a 6-month plan (with a 20% discount).Commitment Period
By subscribing, you agree to the full duration of the selected plan (3 or 6 months) and the associated terms, including discounted pricing and payment obligations.Cancellation Policy
Subscriptions can be canceled with 30 days’ written notice at any time during the commitment period.
If cancellation occurs before the end of the plan, the customer must pay 25% of the subscription fee for the following month as an early termination charge.
Renewals
Subscriptions automatically renew at the end of the commitment period unless canceled in advance with 30 days’ written notice.Payment Terms
All subscription fees are payable in advance with a 50% deposit, the remainder due at the next billing date
Discounts are applied only for the duration of the selected commitment period.
Changes to Terms
We reserve the right to amend these terms with 30 days’ notice to subscribers.
14. Late Payment Terms & Conditions
All invoices are due within 7 days of the invoice date. Payments not received within 30 days will incur a late fee of 5% per month (60% annualised). The client agrees to cover any legal or collection fees incurred due to overdue payments. Ownership of all creative assets remains with The2Peas Marketing PTY LTD until payment is made in full. Failure to pay within 30 days may result in the suspension of ongoing services.
In addition to interest charges stated above, any time spent on project management during this time will be added to the invoice at a rate of $150 excl GST per hour.
